Call to Order President Jerad Cypher called the meeting to order at 6:00 pm.

Pledge of Allegiance Lead by President, Jerad Cypher.
Mayor Gomber administered Oath of Office for Jerry Cypher as appointed Council Member to fill vacancy of Council Member, Chris Mascara. Appointment until the end of the term or until the next general election.
Motion Guy Tucci, second Mary Taufer to approve minutes of June 5, 2017 and June 16, 2017. Motion passed
Motion Mary Taufer, second Guy Tucci, to approve bills – General $ 55,561.30. Motion passed.
Action Items:
- Motion Mary Taufer, second Guy Tucci to approve Resolution 008 of 2017 – Placement of Pony League World Series Banner. Motion passed.
- Motion Mary Taufer, second Guy Tucci, to accept resignation of Council Member, Tamara Chacko with regrets. Appointment to be made within 30 days. Motion passed.
- Motion Jerad Cypher, second Guy Tucci, to direct Secretary to post the Vacant Council Member seat on the borough website. Motion passed.
- Motion Mary Taufer, second Jerad Cypher, to approve Resolution 007 of 2017 – Update timesheet acknowledgement. Timesheets due the Wednesday prior to the Friday pay date. Motion passed.
- Motion Guy Tucci, second Mary Taufer to direct Borough Engineer, Widmer Engineering to perform a survey showing easement drawings at the Lingg-Augustine properties on Thayer Street at a cost not to exceed $800 per property Total $1,600.00. Motion passed. Jerry Cypher abstained.
Discussion:
After review of concerns from Mr. Walter Brumm at 145 Wilmont Avenue, Council determined that the drainage pipe line to be constructed in the paper alley by Mr. David Kucherawy at 115 Wilmont Ave. is between property owners and a private property issue.
Motion Mary Taufer, second Jerry Cypher to have Solicitor Makel send agreement and letter to indemnify and hold harmless East Washington Borough because Mr. David Kucheraway, 115 Wilmont Avenue will be installing a storm water drainage pipe in the paper alley. No permit is necessary if on private property however, a property owner cannot divert storm water on to his neighbor’s property. Motion passed.
Council discussed the Wheeling/Thayer – WEWJA sewer lines – These lines were not slated for repair. Further evaluation from WEWJA.
Unfinished Business:
Lingg property on Thayer.
Sarah Boyce-Widmer Engineering, Inc.
Sarah Boyce gave a detailed complete history of events regarding the Storm Sewer – Lingg property at 33 Thayer Street.
Council discussed at length the issue with the storm sewer, the wall on Mr. Lingg’s property at 33 Thayer Street that was taken down. HLS Landscaping, Garrett Hettman was the contractor that performed the work at that site. Council approved Widmer Engineering to conduct a survey of the Lingg and Augustine properties. Mr. Lingg is dissatisfied with the work done by HLS Landscaping. The initial pipe issue began in 2015 due to an emergency pipe repair at the park on Thayer Street. Mr. Lingg’s property is adjacent to the East Washington Borough Park. Mr. Hettman requested full payment for work performed.
President Cypher stated that the Borough keeps using taxpayer’s money for repairs with poor work done by contractors, and/or not adhering to the insurance, bonding, payment and performance requirements as set forth in the Borough Code. Due to bonding issues and work performance a motion was made:
Motion Guy Tucci, second Mary Taufer to authorize payment of $8,250.00 to HLS Landscaping, Garrett Hettman subject to the following:
- Direct Borough Engineer to do a punch list of items that still need to be done.
- Copy to Council that was completed by Contractor and project to be completed
by July 31, 2017. Motion passed.
New Business:
Jerad Cypher commented that some minor repair may be needed to the Borough rented garage roof from storm. No damage to contents inside. Home owner has notified their insurance carrier.
A Right of Way Easement must be obtained from the property owner before any Borough employee, and/or Contractor may perform any work on their property.
New Code Enforcement, Gerald Coleman began working part time for the borough on June 20, 2017.
Mayor Gomber suggested that the borough may consider tar and chip a few of the asphalt streets in the borough. The tar seals the holes in the road.
There is some Damage done to the sewer drain at Lemoyne Ave. EXT. Need to survey near pool.
Motion Jerry Cypher, second Jerad Cypher to obtain the necessary right of way easements for the sewer damage at Lemoyne Ave Ext. near Elmhurst Pool. Solicitor Makel to notify property owner and obtain right of way easements. There is a void in the sewer. Tabled until the next meeting. Motion passed.
EXECUTIVE SESSION
Motion Mary Taufer, second Jerry Cypher to hire Damion Collins as an hourly part-time seasonal employee, Public Works Department at a salary of $10.00 per hour with no benefits. (2 days per week) (not to exceed 16 hours per week) Motion passed.
